{"id":120317,"date":"2023-01-11T09:16:27","date_gmt":"2023-01-11T14:16:27","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=120317"},"modified":"2023-01-11T09:16:27","modified_gmt":"2023-01-11T14:16:27","slug":"scalia-was-basically-a-klansman-emory-law-professor","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/scalia-was-basically-a-klansman-emory-law-professor\/","title":{"rendered":"&#8216;Scalia was basically a Klansman\u2019: Emory law professor"},"content":{"rendered":"<p><em><strong>Because he objected to a racial bias claim in a death penalty case<\/strong><\/em><\/p>\n<p>The late Supreme Court Justice Antonin Scalia \u201cwas basically a Klansman,\u201d according to a law professor at Emory University.<\/p>\n<p>Professor Darren Hutchinson tweeted what appeared to be a Facebook status where he made the comments about the late conservative justice.<\/p>\n<p>Hutchinson (<em>pictured<\/em>), the law school\u2019s chief diversity officer, said he is teaching a critical race theory seminar that included reviewing a 1987 Supreme Court decision on racial bias and the death penalty.<\/p>\n<p>Justice Scalia promoted the agenda of the Ku Klux Klan because he voted with four other justices in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/481\/279\/#tab-opinion-1957081\" target=\"_blank\" rel=\"noopener\"><em>McCleskey v. Kemp<\/em><\/a> to reject a racial bias claim in a death penalty case, according to the professor. Hutchinson cited a memo that Scalia wrote to other justices where he explained his decision and said even if racial bias was shown in sentencing, it would not change his opinion. The late justice was a <a href=\"https:\/\/www.youtube.com\/watch?v=294acuaTeZ4\" target=\"_blank\" rel=\"noopener\">devout Catholic<\/a>, which made him a member of a group targeted for violence and hatred by the KKK.<\/p>\n<p>The comment from Hutchinson drew criticism from George Washington University law professor Jonathan Turley. Hutchinson made his Twitter account private this morning after publication of Turley\u2019s blog. <em>The College Fix<\/em> archived his Facebook status (<em>below<\/em>).<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-120319\" src=\"https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72-370x247.jpg\" alt=\"\" width=\"452\" height=\"302\" srcset=\"https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72-370x247.jpg 370w, https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72-560x373.jpg 560w, https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72-135x90.jpg 135w, https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72-768x512.jpg 768w, https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72-300x200.jpg 300w, https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/01\/HutchinsonFB72.jpg 900w\" sizes=\"(max-width: 452px) 100vw, 452px\" \/><\/p>\n<p>&#8220;The case has long generated debate with many law professors disagreeing with the Court\u2019s holding,\u201d Professor Turley wrote on his personal <a href=\"https:\/\/jonathanturley.org\/2023\/01\/11\/emory-law-professor-denounces-the-late-antonin-scalia-as-basically-a-klansman\/#more-199119\" target=\"_blank\" rel=\"noopener\">blog<\/a>. \u201cHowever, one can disagree with the Eleventh Circuit and the Supreme Court without labeling such jurists as white robbed racists.\u201d<\/p>\n<p>Turley wrote that Hutchinson\u2019s KKK comparison would likely dissuade students in his class from making arguments in support of the decision, thus inhibiting free discussion.<\/p>\n<p>Turley wrote:<\/p>\n<blockquote><p>It is also concerning that this is a reference to Hutchinson\u2019s class. If the professor maintains that anyone supporting the decision is effectively a klansman, it is hard to see how students in his class would feel comfortable in voicing such a view.
