{"id":125096,"date":"2023-03-30T00:06:56","date_gmt":"2023-03-30T04:06:56","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=125096"},"modified":"2023-03-29T15:52:16","modified_gmt":"2023-03-29T19:52:16","slug":"ucla-scholars-cut-ties-with-ice-and-end-gang-database-to-fight-racism","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/ucla-scholars-cut-ties-with-ice-and-end-gang-database-to-fight-racism\/","title":{"rendered":"UCLA scholars: Cut ties with ICE and end gang database to fight racism"},"content":{"rendered":"<p><em><strong>Study on racism against Asians finds it still exists today in California<\/strong><\/em><\/p>\n<p>A professor and a law fellow at the University of California Los Angeles want to see the state end ties with Immigration and Customs Enforcement and eliminate a gang database.<\/p>\n<p>The demands are the results of a <a href=\"https:\/\/www.aasc.ucla.edu\/aapipolicy\/summit2022\/reports_feb10\/Motomura_report.pdf\" target=\"_blank\" rel=\"noopener\">28-page report<\/a> meant to investigate ways to ameliorate racism against Asian Americans and Pacific Islanders. Many examples in the report date back to 19th or early 20th century laws. The report appears to be partially funded from a <a href=\"https:\/\/www.thecollegefix.com\/california-university-researchers-receive-1-4-million-to-study-hate-crimes-against-asian-americans\/\" target=\"_blank\" rel=\"noopener\">$1.4 million grant<\/a> allocated in 2021 to study hate incidents and crimes against Asians.<\/p>\n<p>Professor Hiroshi Motomura and Law Fellow Astghik Hairapetian made their arguments in a report titled \u201cAnti-AAPI racism in Immigration and Criminal Law.&#8221; Motomura is a former immigration adviser to President Barack Obama and Hairapetian specialized in &#8220;Critical Race Studies and International and Comparative Law,&#8221; as a <a href=\"https:\/\/www.promisehumanrights.blog\/team\/2020\/12\/astghik-hairapetian\" target=\"_blank\" rel=\"noopener\">law student<\/a> at UCLA.<\/p>\n<p>The report pointed out that early on \u201c[e]xplicit anti-AAPI racism motivated early immigration and criminal statutes in both federal and California law.\u201d For example, connecting immoral behavior such as prostitution to Asian women as a group.<\/p>\n<p>The report goes on to state that \u201cthe passage of time did little to expunge the racist roots of these laws or the anti-AAPI sentiments entwined in their history\u201d and \u201c[c]rimes involving moral turpitude remained a basis for exclusion and deportation.\u201d<\/p>\n<p style=\"text-align: center;\"><strong>MORE:<\/strong> <a href=\"https:\/\/www.thecollegefix.com\/going-vegan-can-help-fight-racism-columbia-instructor-says\/\" target=\"_blank\" rel=\"noopener\">Columbia instructor urges vegan eating to fight racism<\/a><\/p>\n<p><em>The College Fix<\/em> reached out to both Motomura and Hairapetian for comment on what their next steps were for their recommendations and if racism in the past meant that the same institutions today, such as immigration agents, were racist by default. Neither responded in the past week.<\/p>\n<p>The report cited the \u201cracist underpinnings\u201d that continue today, such as a 2017 California law that \u201chas troubling exceptions that allow federal immigration and criminal laws to harm AAPI communities.\u201d<\/p>\n<p>In particular, the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201720180SB54\" target=\"_blank\" rel=\"noopener\">California Values Act<\/a> \u201cpermits state and local law enforcement to transfer individuals to Immigration and Customs Enforcement if an individual has certain criminal convictions\u201d but \u201cCalifornia\u2019s statewide representation program does not permit funds to be used to represent individuals in removal proceedings who have certain criminal convictions.\u201d The law overall limits the ability of law enforcement to cooperate with immigration authorities and has the <a href=\"https:\/\/www.aclusocal.org\/en\/know-your-rights\/california-values-act-sb-54#:~:text=The%20California%20Values%20Act%20(SB,for%20everyone%20in%20our%20community.\" target=\"_blank\" rel=\"noopener\">support<\/a> of the ACLU.<\/p>\n<p>They also called for the abolition of a database called CalGang which collects data on gang members in California, saying that \u201cinclusion in a gang database can still lead the federal government to view a noncitizen as a \u201cthreat to public safety,\u201d and thus a priority for arrest, detention, and deportation.\u201d<\/p>\n<p>They believe this is unfair because CalGang reportedly recorded inaccurate information.
