Abbott signs law abolishing DEI offices at Texas colleges, universities"},"content":{"rendered":"<p><em><strong>Texas becomes second state after Florida to abolish DEI offices in higher education<\/strong><\/em><\/p>\n<p>Texas Gov. Greg Abbott on Wednesday signed into law legislation that eliminates diversity, equity and inclusion offices at the state&#8217;s public colleges and universities.<\/p>\n<p>\u201cAn institution of higher education may not establish or maintain a diversity, equity, and inclusion office or hire or assign an employee of the institution, or contract with a third party, to perform the duties of a diversity, equity, and inclusion office,\u201d <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=88R&amp;Bill=SB17\" target=\"_blank\" rel=\"noopener\">states<\/a> the legislation, Senate Bill 17, which takes effect at the start of the spring semester of the 2023-24 academic year.<\/p>\n<p>Exceptions spelled out include \u201cacademic course instruction,\u201d \u201cresearch or creative works by an institution of higher education\u2019s students or faculty,\u201d and activities by student groups.<\/p>\n<p>The new law also bans \u201cideological oaths,\u201d or DEI statements, for hiring and enrollment.<\/p>\n<p>\u201cThe days of political oaths, compelled speech, and racial profiling in university hiring are behind us,\u201d state Sen. Brandon Creighton, R-Conroe, the bill\u2019s co-author, reportedly <a href=\"https:\/\/www.kpvi.com\/news\/national_news\/with-ban-looming-for-dei-offices-whats-next-for-dentons-colleges\/article_75a62f2a-7d64-5bad-ab45-11c60266a3b3.html\" target=\"_blank\" rel=\"noopener\">said<\/a> after the bill&#8217;s passage. \u201cMoving forward, Texas will prioritize the advancement of the most qualified individuals and endorse policies that promote diversity and equality for our great state.\u201d<\/p>\n<p>Any student or employee required to participate in any actions that violate the law \u201cmay bring an action against the institution for injunctive or declaratory relief.\u201d<\/p>\n<p>In response to the new law, Texas Students for DEI said the group is not surprised, but disappointed.<\/p>\n<p>&#8220;You have put the quality of higher education in Texas at risk. We will continue mobilizing advocates for DEI and tenure, regardless. Thank you to everyone who has been supporting us in this fight; we won\u2019t give up,&#8221; the group <a href=\"https:\/\/twitter.com\/TexasforDEI\/status\/1669098581616209920\" target=\"_blank\" rel=\"noopener\">stated<\/a> on Twitter.<\/p>\n<p>Texas becomes the second state, <a href=\"https:\/\/www.thecollegefix.com\/desantis-signs-law-to-defund-and-eliminate-colleges-dei-programs\/\" target=\"_blank\" rel=\"noopener\">behind Florida<\/a>, to abolish DEI offices in higher education. A North Dakota bill also signed into law this spring bans public universities from requiring DEI statements or noncredit diversity trainings for students and staff, <em>Inside Higher Ed<\/em> <a href=\"https:\/\/www.insidehighered.com\/news\/quick-takes\/2023\/04\/27\/north-dakota-quietly-enacts-first-anti-dei-law#\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>The new Texas law requires public universities eliminate the use of race, sex or ethnicity as a measuring standard for employment or academic programs. Essentially, universities are required to make \u201ccolor-blind and sex-neutral\u201d decisions, it states.<\/p>\n<p>Joe Cohen, legislative and policy director at the Foundation for Individual Rights and Expression, told <em>The Fix<\/em> via email that in order to \u201cprotect free speech and preserve academic freedom, the bill appropriately states that these requirements will not apply to classroom instruction or research conducted at the institutions.\u201d<\/p>\n<p>\u201cThese are positive developments that will advance the free speech and academic freedom rights of students and faculty who have too often been subject to censorship in the name of promoting particularly narrow conceptions of diversity, equity and inclusion,\u201d Cohen said.<\/p>\n<p>Several groups have expressed concern, including those who are set to lose their jobs in DEI offices. The Texas legislature added a provision to protect former employees, allowing them to transfer to other jobs on campus.<\/p>\n<p>&#8220;A public institution of higher education may provide to each employee in good standing at the institution whose position is eliminated as a result of the implementation of &#8230; this Act, a letter of recommendation for employment for a position at the institution or elsewhere,&#8221; it states.<\/p>\n<p style=\"text-align: center;\"><strong>MORE: <a href=\"https:\/\/www.thecollegefix.com\/gov-abbott-signs-texas-law-banning-biological-men-from-female-collegiate-sports\/\" target=\"_blank\" rel=\"noopener\">Gov.
