{"id":133068,"date":"2023-08-30T00:04:48","date_gmt":"2023-08-30T04:04:48","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=133068"},"modified":"2023-08-29T11:19:13","modified_gmt":"2023-08-29T15:19:13","slug":"some-california-catholic-universities-cover-abortion-in-health-plan","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/some-california-catholic-universities-cover-abortion-in-health-plan\/","title":{"rendered":"Some California Catholic universities cover abortion in health plan"},"content":{"rendered":"<p><strong>ANALYSIS:<\/strong><em><strong> University of San Diego said it must cover abortions in health plans &#8211; but other Catholic universities have found a way around the issue<\/strong><\/em><\/p>\n<p>At least three Catholic universities in California cover abortion in their student health plans, according to a <em>College Fix<\/em> investigation. Some Catholic universities in the state have found ways to avoid covering the deliberate destruction of human life.<\/p>\n<p><em>The Fix<\/em> discovered two schools, the <a href=\"https:\/\/www.aetnastudenthealth.com\/schools\/usfca\/pdbs2324.pdf\" target=\"_blank\" rel=\"noopener\">University of San Francisco<\/a> and <a href=\"https:\/\/go.gallagherstudent.com\/Universities\/Loyola%20Marymount%20University\/Home\" target=\"_blank\" rel=\"noopener\">Loyola Marymount University<\/a>, that help students obtain abortions through their health plans for the 2023-24 school year.<\/p>\n<p>Last month, <em>The Fix<\/em> <a href=\"https:\/\/www.thecollegefix.com\/catholic-university-wont-explain-why-it-helps-students-get-abortions\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> on the University of San Diego&#8217;s inclusion of abortion in its student health plan.<\/p>\n<p>The Catholic Church <a href=\"https:\/\/www.usccb.org\/issues-and-action\/human-life-and-dignity\/abortion\/respect-for-unborn-human-life\" target=\"_blank\" rel=\"noopener\">teaches<\/a> the killing of an unborn baby is \u201cintrinsically evil,\u201d and Pope Francis and a long line of his <a href=\"https:\/\/www.usccb.org\/issues-and-action\/human-life-and-dignity\/abortion\/respect-for-unborn-human-life\" target=\"_blank\" rel=\"noopener\">predecessors<\/a> consistently have spoken out against abortion. Pope Francis once <a href=\"https:\/\/www.catholicnewsagency.com\/news\/249172\/pope-francis-abortion-statements\" target=\"_blank\" rel=\"noopener\">compared<\/a> it to \u201chiring a hitman.\u201d<\/p>\n<p>A recent <a href=\"https:\/\/adfmedia.org\/case\/skyline-wesleyan-church-v-california-department-managed-health-care\" target=\"_blank\" rel=\"noopener\">court settlement<\/a> involving Protestant churches in California potentially opened the doors for Catholic universities to opt out of a state mandate that requires health insurance plans to include coverage for elective abortions.<\/p>\n<p>However, none of the three universities answered questions from <em>The Fix<\/em> about whether they attempted to request a waiver. The California Department of Managed Health Care also did not respond to a request from <em>The Fix<\/em> asking if any of the universities requested a waiver.<\/p>\n<p><em>The College Fix<\/em> contacted USF and Loyola twice in the past two weeks and asked why they cover abortion and if they requested a waiver. Neither responded to emailed requests for comment.<\/p>\n<p>A <a href=\"https:\/\/www.thecollegefix.com\/catholic-california-university-covers-abortion-in-student-health-insurance-plan\/\" target=\"_blank\" rel=\"noopener\">prior<\/a> <em>Fix<\/em> investigation in 2021 found USF covered abortion, and the diocese, run by conservative Archbishop Salvatore Cordileone, declined to comment. A year later, Cordileone asked all his churches to deny Communion to Congresswoman Nancy Pelosi, who represents San Francisco, because of her persistent support for abortion.<\/p>\n<p>Previously, a University of San Diego media relations spokesperson told <em>The Fix<\/em> the school covers abortion because it is required to by state and federal regulations. It did not respond to a question asking if USD planned to seek a waiver.<\/p>\n<p>As <em>The Fix<\/em> reported in July, several Protestant churches challenged the California insurance mandate and won a legal settlement in May that exempts them from covering elective abortions.<\/p>\n<p>Their lawyer, Jeremiah Galus, senior counsel with Alliance Defending Freedom, said the resolution represented a major victory for all religious organizations in California.<\/p>\n<p>\u201cThe government can\u2019t force a church or any other religious employer to violate their faith and conscience by participating in funding abortion,\u201d Galus said in a statement in May.<\/p>\n<p>The California Department of Managed Health Care reviews exemptions for religious employers. In July, a DMHC spokesman <a href=\"https:\/\/timesofsandiego.com\/education\/2023\/07\/28\/usd-is-targeted-by-conservative-catholic-media-for-health-plan-allowing-abortions\/\" target=\"_blank\" rel=\"noopener\">told<\/a> the <em>Times of San Diego<\/em> that the University of San Diego did not request an exemption.<\/p>\n<p style=\"text-align: center;\"><strong>MORE:<\/strong> <a href=\"https:\/\/www.thecollegefix.com\/transgender-surgeries-nearly-tripled-in-3-years-study\/\" target=\"_blank\" rel=\"noopener\">Transgender surgeries nearly tripled in 3 years: study<\/a><\/p>\n<p>Spokesman Kevin Durawa said employers should contact the department if they believe \u201cthey fall under a religious exemption under the law.\u201d<\/p>\n<p>However, a USD media relations spokesperson told the newspaper the university \u201cdoes not qualify as a religious employer under the cited statute. The University of San Diego is a religiously affiliated university that is not exempt from certain state and federal laws.\u201d<\/p>\n<p>The Catholic University of America, which is subject to the same federal laws as USD, <a href=\"https:\/\/www.thecollegefix.com\/catholic-university-of-america-removes-abortion-from-health-plan\/\" target=\"_blank\" rel=\"noopener\">does not<\/a> provide for abortion in its student health plans.<\/p>\n<p>The Diocese of San Diego also declined to comment to The Fix in July on the actions of the Catholic university in its jurisdiction.<\/p>\n<p>External Media and Community Relations Director Kevin Eckery said, \u201cthis is something for USD to comment on,\u201d and redirected the questions to the university\u2019s press office.<\/p>\n<p>His comments appear to be in conflict with the Code of Canon Law, which governs the Catholic Church. Canon 810 <a href=\"https:\/\/www.vatican.va\/archive\/cod-iuris-canonici\/eng\/documents\/cic_lib3-cann793-821_en.html\" target=\"_blank\" rel=\"noopener\">specifies<\/a> bishops \u201chave the duty and right of being watchful so that the principles of Catholic doctrine are observed faithfully in [Catholic] universities.\u201d<\/p>\n<p><em><strong>Some Catholic universities find a way to get around the problem<\/strong><\/em><\/p>\n<p>Other universities do not clearly provide for abortion in their health plans or avoid the issue altogether by not offering plans or self-insuring.<\/p>\n<p><em>The Fix<\/em> investigation found Mount Saint Mary\u2019s University in Los Angeles and Santa Clara University no longer cover abortions in their student health plans. Santa Clara is not considered a \u201creligious employer\u201d under the law but does not cover abortions, according to the <a href=\"https:\/\/www.catholicnewsagency.com\/news\/255148\/analysis-do-californias-catholic-universities-have-to-include-abortion-in-their-health-plans\" target=\"_blank\" rel=\"noopener\">Catholic News Agency<\/a>.<\/p>\n<p>The Mount St. Mary\u2019s plan formerly covered 80 percent of the cost for an abortion in its 2019-20 policy and 2021-22 policy, but the 2023-24 <a href=\"https:\/\/student.jcbins.com\/storage\/app\/student-public\/Mount%20Saint%20Marys%20University%202324%20PDBS_FINAL%20FORMATTED.pdf\" target=\"_blank\" rel=\"noopener\">policy<\/a> through Aetna does not include abortion coverage. <em>The Fix<\/em> reached out to the university to confirm it does not cover abortion. The university has yet to respond to the Aug. 24 email.<\/p>\n<p>At Santa Clara University, the <a href=\"https:\/\/www.aetnastudenthealth.com\/schools\/santaclara\/pdbs2324.pdf\" target=\"_blank\" rel=\"noopener\">summary<\/a> of benefits for the 2023-24 student plan from Aetna does not include abortion. However, the student health <a href=\"https:\/\/eoc.anthem.com\/eocdps\/ca\/5YVFSH08152022L00478MG02\" target=\"_blank\" rel=\"noopener\">insurance policy<\/a> for 2022-23 through BlueCross listed abortion coverage.<\/p>\n<p>A spokesman for Santa Clara did not respond to multiple requests for comment.<\/p>\n<p>Two other Catholic higher education institutions do not appear to offer student health insurance plans at all &#8211; Notre Dame de Namur University and John Paul the Great University.
