{"id":133877,"date":"2023-09-14T00:07:43","date_gmt":"2023-09-14T04:07:43","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=133877"},"modified":"2023-09-14T00:58:54","modified_gmt":"2023-09-14T04:58:54","slug":"harvard-ethics-professor-hits-back-against-data-fraud-allegations-with-defamation-lawsuit","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/harvard-ethics-professor-hits-back-against-data-fraud-allegations-with-defamation-lawsuit\/","title":{"rendered":"Harvard ethics professor hits back against data fraud allegations with defamation lawsuit"},"content":{"rendered":"<p>A prominent Harvard scholar who has been accused of data falsification is fiercely defending her reputation, filing a defamation lawsuit that argues she faces gender discrimination and defamation of character.<\/p>\n<p>Harvard Business School Professor Francesca Gino filed the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.259933\/gov.uscourts.mad.259933.1.0.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> in August against the university and the trio of data scientists who accused her of falsifying data in as many as four separate research papers.<\/p>\n<p>A statement provided by Gino\u2019s representatives to <em>The College Fix<\/em> from her attorney, Andrew Miltenberg, argues that Harvard showed disregard for evidence, due process and confidentiality when it suspended Gino without pay.<\/p>\n<p>\u201cThe University\u2019s lack of integrity in its review process stripped Prof. Gino of her rights, career and reputation \u2013 and failed miserably with respect to gender equity,\u201d Miltenberg said.<\/p>\n<p>Among its proposed points against the university and the scientists, the lawsuit alleges that \u201cHarvard\u2019s gender bias against women was a motivating factor in HBS\u2019s [Harvard Business School] decision to subject Plaintiff to an onerous investigation and to impose upon her severe penalties, including unpaid administrative leave for two years.\u201d<\/p>\n<p>\u201cHarvard and HBS are also known for treating female faculty less favorably than male faculty,\u201d it added.<\/p>\n<p>The three professors named in the lawsuit are Joseph Simmons of the University of Pennsylvania, Uri Simonsohn of the Escade Business School in Spain, and Leif Nelson of the University of California, Berkeley.<\/p>\n<p>They <a href=\"https:\/\/www.thecollegefix.com\/harvard-ethics-professor-allegedly-fabricated-multiple-behavioral-science-studies\/\" target=\"_blank\" rel=\"noopener\">accused<\/a> Gino of committing data fraud in a <a href=\"http:\/\/datacolada.org\/109\" target=\"_blank\" rel=\"noopener\">four<\/a>&#8211;<a href=\"http:\/\/datacolada.org\/110\" target=\"_blank\" rel=\"noopener\">part<\/a> <a href=\"http:\/\/datacolada.org\/111\" target=\"_blank\" rel=\"noopener\">blog<\/a> <a href=\"http:\/\/datacolada.org\/112\" target=\"_blank\" rel=\"noopener\">series<\/a> for a blog called \u201cData Colada.\u201d The accusations were published periodically over this summer after they were first presented to Harvard in July 2021.<\/p>\n<p>In response, Gino filed a lawsuit on Aug. 3 after being notified that she would be <a href=\"https:\/\/www.thecrimson.com\/article\/2023\/8\/3\/hbs-prof-lawsuit-data-fraud-defamation\/\" target=\"_blank\" rel=\"noopener\">placed<\/a> on administrative leave and <a href=\"https:\/\/www.thecrimson.com\/article\/2023\/8\/28\/gino-tenure-review-begins\/\" target=\"_blank\" rel=\"noopener\">revoked<\/a> of her professorship, according to the <em>Harvard Crimson.<\/em><\/p>\n<p>The lawsuit alleges that Harvard Business School and the three scientists collaborated against Gino and her research despite lack of evidence, which resulted in \u201csevere emotional distress,\u201d among other consequences.<\/p>\n<p><em>The Fix<\/em> contacted in recent weeks via email Simmons, Simonsohn and Nelson for their comment on the lawsuit. None have responded.<\/p>\n<p>But the scholars have discussed the lawsuit on their blog.<\/p>\n<p>In a Sept. 1 <a href=\"http:\/\/datacolada.org\/113\" target=\"_blank\" rel=\"noopener\">post<\/a> called \u201cData Litigada,\u201d they said their respective employers are going to help with the initial stages of the legal battle and they stand behind their work, pointing out that the data tampering they alleged in four papers \u201chave since been retracted (or re-retracted).\u201d<\/p>\n<p>The professor also thanked supporters for donating to their legal fund, adding \u201cyour response has sent a message, to us, to our universities, to each other, and to the world: It is not OK to use the legal system to punish scientists for drawing reasonable conclusions from stated facts.\u201d<\/p>\n<p>Part one of Data Colada\u2019s initial series, called \u201cClusterfake,\u201d was published on June 17 and states: \u201cIn 2021, we and a team of anonymous researchers examined a number of studies co-authored by Gino, because we had concerns that they contained fraudulent data. We discovered evidence of fraud in papers spanning over a decade, including papers published quite recently (in 2020).\u201d<\/p>\n<p>But Gino\u2019s representatives pointed <em>The College Fix<\/em> to a YouTube interview published just over a month later, on July 18, during which Simonsohn said there is a lack of evidence: \u201cMy belief is that she did it. But there is no evidence. But it doesn\u2019t really matter.\u201d<\/p>\n<p><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/OPUKyeetdt8?si=4SVnOiPo_Y2gCfgb&amp;start=530\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><em>The College Fix<\/em> emailed Simonsohn several times in recent weeks and asked for clarification on these statements but has not received a response.<\/p>\n<p>Gino\u2019s spokespeople also provided a statement from Harvard Business School Technology and Operations Management Professor Frances Frei in defense of the embattled scholar.<\/p>\n<p>\u201cThe more I learn about the process used in these investigations, the more troubled I am. Prof. Gino\u2019s career and life have been shattered without any proof she did anything wrong,\u201d Frei stated.<\/p>\n<p>\u201cI\u2019m honestly shocked,\u201d she continued. \u201cAs a fellow professor and researcher, it\u2019s disturbing and frankly terrifying.
