{"id":137077,"date":"2023-11-10T00:03:53","date_gmt":"2023-11-10T05:03:53","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=137077"},"modified":"2023-11-09T10:03:40","modified_gmt":"2023-11-09T15:03:40","slug":"penn-affiliates-say-university-violates-fiduciary-duty-with-oil-and-gas-investments-complaint","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/penn-affiliates-say-university-violates-fiduciary-duty-with-oil-and-gas-investments-complaint\/","title":{"rendered":"Penn affiliates say university violates &#8216;fiduciary duty&#8217; with oil investments: complaint"},"content":{"rendered":"<p><em><strong>Penn&#8217;s investments are &#8216;imperiling the university\u2019s financial and physical condition&#8217;<\/strong><\/em><\/p>\n<p>University of Pennsylvania\u2019s investments in oil, gas, and coal violate the school\u2019s \u201cfiduciary duty,\u201d according to a complaint filed with the attorney general\u2019s office and supported by students, faculty, and outside groups.<\/p>\n<p>Attorneys at the <a href=\"https:\/\/climatedefenseproject.org\/about\/\" target=\"_blank\" rel=\"noopener\">Climate Defense Project<\/a>, an environmental advocacy group that fights for \u201cclimate justice,\u201d filed <a href=\"https:\/\/climatedefenseproject.org\/wp-content\/uploads\/2023\/10\/University-of-Pennsylvania-Complaint.pdf\" target=\"_blank\" rel=\"noopener\">the complaint<\/a> with Pennsylvania Attorney General Michelle Harris and asked her investigate and order Penn to end all of its investments with ties to the fossil fuel industry.<\/p>\n<p>Over 40 UPenn faculty members and 35 student groups signed on to the complaint along with 10 national organizations, although all the names of the students and faculty were removed from the public letter.<\/p>\n<p><em>The College Fix<\/em> reached out to attorneys at the Climate Defense Project to ask if the attorney general had responded to the complaint.<\/p>\n<p>The Climate Defense Project did not respond to requests for comment sent in the past two weeks.<\/p>\n<p>The board of trustees \u201chave a fiduciary duty to invest with consideration for the University\u2019s \u2018charitable purposes\u2019 \u2014 a duty that distinguishes non-profit institutions from other investors,\u201d the complaint stated.<\/p>\n<p>\u201cInstead, the Board of Trustees has invested a portion of their $21 billion endowment in the fossil fuel industry \u2014 damaging the world\u2019s natural systems;\u201d according to the complaint. The investments are also \u201cdisproportionately harming youth, low-income people, and communities of color; and imperiling the university\u2019s financial and physical condition.\u201d<\/p>\n<p>Penn did not respond to requests for comment sent in the past two weeks and a spokesperson for the attorney general\u2019s office told <em>The Fix<\/em> he had \u201cnothing to offer at this point.\u201d<\/p>\n<p><em>The Fix<\/em> reached out to Fossil Free Research, a group that advocates fossil fuel divestment in higher education and that was a signatory on the complaint. <em>The Fix<\/em> asked if the group was aware of any university response to the complaint and what next steps it would take against the school.<\/p>\n<p>\u201cWhile we did sign on in support of Fossil Free Penn&#8217;s legal action, we are not the right group to ask about how the university has responded,\u201d Jake Lowe, the group&#8217;s executive director, told <em>The Fix<\/em>. \u201cI&#8217;d encourage you to reach out to the student organizers from Fossil Free Penn for more on this,\u201d Lowe said.<\/p>\n<p style=\"text-align: center;\"><strong>MORE:<\/strong> <a href=\"https:\/\/www.thecollegefix.com\/penn-business-school-offers-new-dei-major\/\" target=\"_blank\" rel=\"noopener\">Penn business school offers new DEI concentration<\/a><\/p>\n<p>Lowe said that he would be able to speak more on the legal complaint rather than the university response.<\/p>\n<p>However, when <em>The Fix<\/em> sent a follow-up inquiry asking about the basis of the complaint, specifically the laws the school is violating by investing in fossil fuels, a separate spokesperson responded on Lowe\u2019s behalf and declined to answer the questions.<\/p>\n<p>\u201cWe are not the specific student group at UPenn who filed the legal complaint and thus we do not have answers to your questions,\u201d the spokesperson said.<\/p>\n<p>The complaint against UPenn is one of <a href=\"https:\/\/climatedefenseproject.org\/resources\/\" target=\"_blank\" rel=\"noopener\">five<\/a> that were recently filed by the Climate Defense Project against prominent universities\u2019 endowments.
