{"id":137304,"date":"2023-11-14T15:51:13","date_gmt":"2023-11-14T20:51:13","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=137304"},"modified":"2023-11-14T15:52:55","modified_gmt":"2023-11-14T20:52:55","slug":"middle-schoolers-blackface-suspension-upheld-despite-legal-warning-from-free-speech-group","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/middle-schoolers-blackface-suspension-upheld-despite-legal-warning-from-free-speech-group\/","title":{"rendered":"Middle schooler&#8217;s &#8216;blackface&#8217; suspension upheld despite legal warning from free speech group"},"content":{"rendered":"<p>The San Diego Unified School District middle schooler who <a href=\"https:\/\/www.thecollegefix.com\/middle-school-student-banned-from-district-sporting-events-for-wearing-blackface\/\" target=\"_blank\" rel=\"noopener\">was suspended<\/a> for wearing &#8220;blackface&#8221; <em>(pictured) <\/em>has had his suspension upheld &#8212; despite a legal warning from the Foundation for Individual Rights and Expression.<\/p>\n<p>The description of student J.A.&#8217;s &#8220;offense&#8221; reads \u201cpainted his face black at a football game\u201d and was noted under the category \u201chate incidents\u201d with \u201coffensive comment, intent to harm.\u201d<\/p>\n<p>J.A. said the paint was just school spirit for the football game. His parents told school officials he never even heard of &#8220;blackface&#8221; until someone told him about it.<\/p>\n<p>These didn&#8217;t matter. Muirlands Middle School Principal Jeff Luna <em>(pictured) <\/em>reportedly declared J.A.&#8217;s paint &#8220;blackface&#8221; because the opposing football team was \u201clargely black.\u201d<\/p>\n<p>In <a href=\"https:\/\/www.thefire.org\/research-learn\/fire-letter-muirlands-middle-school-november-8-2023\" target=\"_blank\" rel=\"noopener\">a letter<\/a> dated November 8, FIRE called on Luna to clear J.A.&#8217;s disciplinary record &#8220;as the First Amendment protects [his] non-disruptive expression of team spirit via a style commonly used by athletes and fans \u2014 notwithstanding your inaccurate description of it as &#8216;blackface.&#8217;\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-137356\" src=\"https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/11\/luna.jpg\" alt=\"\" width=\"218\" height=\"250\" srcset=\"https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/11\/luna.jpg 218w, https:\/\/www.thecollegefix.com\/wp-content\/uploads\/2023\/11\/luna-96x110.jpg 96w\" sizes=\"(max-width: 218px) 100vw, 218px\" \/>FIRE included numerous photos of professional athletes with face paint just like J.A.&#8217;s, noting &#8220;Such use of eye black began as a way to reduce glare during games, but long ago evolved into &#8216;miniature billboards for personal messages and war-paint slatherings.&#8217;\u201d<\/p>\n<p>&#8220;There is no evidence J.A.\u2019s face paint caused a disruption\u2014let alone a material and substantial one\u2014at the football game or at school afterward,&#8221; FIRE continued. &#8220;The complete lack of disruption is unsurprising, as the sight of fans in face paint is familiar to and expected by anyone who has ever attended a football game or other sporting event.&#8221;<\/p>\n<p>As the &#8220;final&#8221; decision to uphold J.A.&#8217;s suspension was made on the same date as the FIRE letter, the free speech organization <a href=\"https:\/\/twitter.com\/TheFIREorg\/status\/1724115818047271044\" target=\"_blank\" rel=\"noopener\">sent a follow-up<\/a> asking SDUSD Superintendent Lamont Jackson if the decision &#8220;will not be reconsidered.&#8221;<\/p>\n<p>The district letter upholding J.A.&#8217;s suspension <em>(pictured) <\/em>says &#8220;schools have a responsibility to maintain and encourage proper standards of behavior for all students,&#8221;
