{"id":137403,"date":"2023-11-15T00:03:45","date_gmt":"2023-11-15T05:03:45","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=137403"},"modified":"2023-11-14T19:25:20","modified_gmt":"2023-11-15T00:25:20","slug":"bipartisan-bill-seeks-to-end-legacy-admissions-in-higher-education","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/bipartisan-bill-seeks-to-end-legacy-admissions-in-higher-education\/","title":{"rendered":"Bipartisan bill seeks to end legacy admissions in higher education"},"content":{"rendered":"<p>Recently introduced bipartisan legislation seeks to end legacy admissions in higher education in the wake of the Supreme Court decision over the summer that ended affirmative action, or preferential race-based admission policies.<\/p>\n<p>Virginia Sen. Tim Kaine, a Democrat, and Indiana Sen. Todd Young, a Republican, proposed the legislation Nov. 7 to put an end to legacy admissions, which gives preferential treatment toward applicants with familial ties to alumni or donors.<\/p>\n<p>\u201cAmerica is a land of opportunity, not a land of aristocracy,\u201d <a href=\"https:\/\/www.young.senate.gov\/newsroom\/press-releases\/young-kaine-introduce-bill-to-end-legacy-admissions\" target=\"_blank\" rel=\"noopener\">said<\/a> Sen. Young in a news release.<\/p>\n<p>The proposal comes in the wake of the Supreme Court\u2019s landmark decision as the national discourse shifted to the controversial use of legacy status, which has been met with growing criticism for perpetuating social and economic inequalities.<\/p>\n<p>The bill\u2019s aim is to \u201censure that first-generation and low-income students are not put at a disadvantage because of their parents\u2019 educational histories or incomes,\u201d Kaine said in the release.<\/p>\n<p>The bill, called the Merit-Based Educational Reforms and Institutional Transparency Act, or MERIT Act, seeks to amend the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/COMPS-765\/pdf\/COMPS-765.pdf\" target=\"_blank\" rel=\"noopener\">Higher Education Act,<\/a> which spells out rules colleges must follow for accreditation and federal funding.<\/p>\n<p>According to the news release, the bill would \u201cadd a new standard for accreditation in order to prevent accredited colleges and universities \u2013 institutions that are recognized for maintaining a certain level of educational quality \u2013 from giving &#8216;preferential treatment&#8217; during the admissions process.\u201d<\/p>\n<p>The legislation also carves out a caveat for religious institutions to protect their ability to make admissions decisions that align with faith-based values, it adds.<\/p>\n<p>It also specifies that it\u2019s still acceptable for applicants to share their personal interests in attending the school, even if that does include parents or other connections to the institution.<\/p>\n<p>Young and Kaine are not alone in advocating for an end to legacy admissions. Several colleges and universities, including Wesleyan University and Virginia Tech, <a href=\"https:\/\/www.thecollegefix.com\/several-universities-end-legacy-admissions-after-affirmative-action-ruled-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">already suspended<\/a> legacy admissions in the weeks following the Supreme Court decision.<\/p>\n<p>Additionally, the University of Minnesota and Occidental College <a href=\"https:\/\/www.thecollegefix.com\/several-universities-end-legacy-admissions-after-affirmative-action-ruled-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">eliminated<\/a> legacy considerations over the summer, reflecting a growing movement toward reevaluating non-merit based admission practices.<\/p>\n<p>Some prestigious universities tend to balk at ending legacy admissions, however, because it hits their wallets, as it would decrease support and engagement, <em>Forbes<\/em> <a href=\"https:\/\/www.forbes.com\/sites\/anafaguy\/2023\/11\/07\/senators-introduce-bipartisan-legislation-to-end-legacy-admissions\/?sh=5effc8bf50ce\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>As<em> The College Fix<\/em> previously <a href=\"https:\/\/www.thecollegefix.com\/new-lawsuit-targets-harvard-legacy-admissions-argues-they-violate-federal-law\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>, three black and Latino groups filed a complaint in July with the Department of Education against Harvard University, alleging the institution\u2019s preferential treatment for legacy and donor applicants violates civil rights law.<\/p>\n<p>Meanwhile, Yale University announced in late October it would review its legacy admissions policy, the <em>Yale Daily News<\/em> <a href=\"https:\/\/yaledailynews.com\/blog\/2023\/10\/27\/yale-to-review-its-legacy-admissions-preference-everything-is-up-for-discussion\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>Wenyuan Wu, executive director of Californians for Equal Rights Foundation, said that while it has a good chance of success given public support, MERIT Act\u2019s focus on legacy admissions will not completely rectify the consequences of affirmative action.<\/p>\n<p>\u201cCombatting legacy admissions, which only takes up a small fragment of preferential college admissions, does not even begin to scratch the surfaces of undoing the harms done by decades-long race-based affirmative action, which is discriminatory and unconstitutional,\u201d Wu told <em>The College Fix<\/em> via email.<\/p>\n<p>Wu said according to <a href=\"https:\/\/www.nber.org\/system\/files\/working_papers\/w29964\/w29964.pdf\" target=\"_blank\" rel=\"noopener\">admissions data<\/a> collected by Duke University Professor Peter Arcidiacono, of individual applications between 2014 and 2019, only about 4,500 applicants were admitted based on legacy preferences.<\/p>\n<p>\u201cThis means only over 2% of all admits were admitted with legacy preferences. Simply put, the \u2018righteous indignation\u2019 against legacy admissions in the wake of the affirmative action ruling is intentional distraction.
