{"id":137534,"date":"2023-11-17T00:08:44","date_gmt":"2023-11-17T05:08:44","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=137534"},"modified":"2023-11-16T14:08:57","modified_gmt":"2023-11-16T19:08:57","slug":"university-broke-state-law-to-hire-black-candidate-over-more-qualified-white-one","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/university-broke-state-law-to-hire-black-candidate-over-more-qualified-white-one\/","title":{"rendered":"University broke state law to hire black candidate over more qualified white one"},"content":{"rendered":"<p><em><strong>Committee re-ranked white, black candidates to avoid \u2018bloodbath,\u2019 investigators say<\/strong><\/em><\/p>\n<p>The University of Washington Department of Psychology violated a non-discrimination policy by putting \u201cinappropriate\u201d emphasis on applicants\u2019 race in a hiring decision earlier this year, a university investigation found.<\/p>\n<p>The <a href=\"https:\/\/drive.google.com\/file\/d\/10EUem763ufA3_w8Q4V-A8j7fKyNnV5NN\/view\" target=\"_blank\" rel=\"noopener\">report<\/a> by the university\u2019s Complaint Investigation &amp; Resolution Office found the department altered its hiring process \u201cto provide disparate opportunities\u201d for a black candidate whom a hiring committee ranked lower than white and Asian candidates.<\/p>\n<p>The public university prohibits discrimination on the basis of race and sex. The decision also violated a state law banning affirmative action practices in the state of Washington, watchdogs say.<\/p>\n<p>Hiring committee members told investigators they faced intense pressure to re-rank candidates for the faculty position based on their race, with one expressing fear of a \u201cbloodbath\u201d if they did not offer the position to the black candidate first.<\/p>\n<p>&#8220;The UW is committed to diversity \u2014 and committed to equal opportunity in hiring \u2014 while upholding University policy and state and federal law,&#8221; spokesperson Victor Balta said in a statement provided to <em>The College Fix<\/em> this week. &#8220;Our students and our state benefit from a faculty whose knowledge and understanding represent the diversity of Washington state.&#8221;<\/p>\n<p>Balta said the psychology department &#8220;inappropriately considered&#8221; candidates&#8217; races in its hiring process earlier this year \u2013 even after being told &#8220;such considerations are inappropriate.&#8221;<\/p>\n<p>As a result, he said, the department is prohibited from tenured faculty hiring for two years. He said they also are launching a comprehensive review and revision of its hiring practices.<\/p>\n<p>John Sailor with the conservative National Association of Scholars, who has followed the issue closely for months and filed a public records request to gain more insight, <a href=\"https:\/\/www.nas.org\/blogs\/article\/university-of-washington-violated-non-discrimination-policy-internal-report-finds\" target=\"_blank\" rel=\"noopener\">reported<\/a> that &#8220;Washington State law, though not mentioned in the report, is no doubt also relevant to the incident.&#8221;<\/p>\n<p>He cited a state ballot initiative adopted in 1998 that &#8220;the state shall not discriminate against, or grant preferential treatment to, any individual or groups on the basis of race, sex, color, ethnicity or national origin in the operation of public employment, public education or public contracting.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Here&#39;s a comment from a University of Washington search committee member, editing an official hiring report.<\/p>\n<p>&quot;I advise deleting the statement below as it shows that URM applications were singled out and evaluated differently than nonURM applications (which is not allowed&#8230;)&quot; <a href=\"https:\/\/t.co\/fRV77jSNtm\">pic.twitter.com\/fRV77jSNtm<\/a><\/p>\n<p>&mdash; John Sailer (@JohnDSailer) <a href=\"https:\/\/twitter.com\/JohnDSailer\/status\/1719794975339106805?ref_src=twsrc%5Etfw\">November 1, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The investigation was launched thanks to an &#8220;internal whistleblower,&#8221; Balta <a href=\"https:\/\/www.insidehighered.com\/news\/faculty-issues\/diversity-equity\/2023\/11\/03\/u-washington-faculty-search-weighed-race\" target=\"_blank\" rel=\"noopener\">told<\/a> <em>Inside Higher Ed.<\/em><\/p>\n<p>The violation involved a search to fill a &#8220;Diversity in Development&#8221; faculty position in the department earlier this year.<\/p>\n<p>On Feb. 28, the hiring committee narrowed a group of 84 applicants down to three viable candidates and ranked them based on the university\u2019s hiring rubric, the investigation report states. Unanimously, the committee put the white candidate first, Asian candidate second, and black candidate third, according to the report. The candidates&#8217; names were redacted.<\/p>\n<p>Following this decision, however, the department\u2019s Strategic Planning Committee asked the hiring committee to \u201cprepare a paragraph justifying why they selected a white candidate for first offer,\u201d according to the report.<\/p>\n<p>The department\u2019s Diversity Advisory Committee also refused to approve the hiring committee\u2019s recommendations, with one member saying they believed the white candidate may have been ranked first due to \u201cundetected\/unacknowledged bias,\u201d the report states.<\/p>\n<p style=\"text-align: center;\"><strong>MORE: <a href=\"https:\/\/www.thecollegefix.com\/faculty-diversity-proposal-fails-at-university-of-washington\/\" target=\"_blank\" rel=\"noopener\">Faculty diversity proposal fails at University of Washington<\/a><\/strong><\/p>\n<p>The diversity committee was given power to influence the hiring committee\u2019s decisions based on an unadopted \u201c<a href=\"https:\/\/www.nas.org\/storage\/app\/media\/New%20Documents\/UW%20Psych%20Faculty%20Search%20Procedures%20Draft%20Document%2015_5_2023.pdf\" target=\"_blank\" rel=\"noopener\">case study<\/a>\u201d document, the investigation found.<\/p>\n<p>The \u201ccase study\u201d required the hiring committee to consider candidates\u2019 racial identity throughout the application process \u2013 and to request the diversity committee\u2019s endorsement before offering jobs to candidates, the report states.<\/p>\n<p>\u201cThe document created by members in the Department \u2013 referred to as a \u2018case study\u2019 \u2013 was determined in the review to contain hiring guidance inconsistent with University policy, and will no longer be used in hiring processes,\u201d the university <a href=\"https:\/\/www.washington.edu\/news\/2023\/10\/31\/university-takes-action-after-faculty-hiring-process-inappropriately-used-race-as-a-factor\/\" target=\"_blank\" rel=\"noopener\">said<\/a> in a Oct. 31 statement.<\/p>\n<p>In March, however, after multiple meetings with the diversity committee, the hiring committee agreed to change its recommendation and rank the black candidate first, the Asian candidate second, and the white candidate third, the report states.<\/p>\n<p>The university investigation found hiring committee members felt pressured to do so because of \u201cDEI\u201d efforts and not because they \u201cchanged their minds about which candidate is most qualified.\u201d<\/p>\n<p>The hiring committee \u201cconceded\u201d the change of order for the following reasons, according to the report:<\/p>\n<blockquote><p>\u201cSo as not to create a \u2018bloodbath\u2019 at a faculty meeting;<\/p>\n<p>\u201cSo the Developmental Area is not accused of \u2018not prioritizing DEI;\u2019<\/p>\n<p>\u201cBecause they were worried junior faculty will hear a lot of \u2018nasty stuff\u2019 said at the faculty meeting and wonder if they were hired simply because of their races;<\/p>\n<p>\u201cBecause they thought it would result in a failed search; and<\/p>\n<p>\u201cBecause it was creating personal stress on them, to the point that [redacted] stated, \u2018I wish I could quit this job\u2019 and [redacted] wrote, \u2018I cannot condone this search process and do not want to be asked to speak about it in person.\u2019\u201d<\/p><\/blockquote>\n<p>On March 16, the Department of Psychology approved offering the position to the black candidate first and, on April 17, the candidate accepted the position, according to the report.<\/p>\n<p>A month later, Dianne Harris, dean of the College of Arts &amp; Sciences, asked the Complaint Investigation and Resolution Office to investigate the situation.<\/p>\n<p>Published Sept. 22, the investigation found the department violated Executive Order 31, the university\u2019s non-discrimination policy, by explicitly considering \u201cracial identities\u201d in its hiring decision.<\/p>\n<p>The university responded Oct. 31 by requiring law and policy training for all Department of Psychology members, taking steps to update its hiring policies to specifically address non-discrimination, eliminating the \u201ccase study\u201d and prohibiting tenured hiring in the department for two years.<\/p>\n<p>Harris and other university leaders also apologized to the affected candidates, according to the university.<\/p>\n<p>\u201cThe successful candidate is unquestionably qualified, and we are proud to have them as a valued faculty member in the department and at the University,\u201d it stated Oct. 31. \u201cThey had no knowledge of the concerns raised and have our full support and respect, which we have communicated directly.\u201d<\/p>\n<p style=\"text-align: center;\"><strong>MORE: <a href=\"https:\/\/www.thecollegefix.com\/u-louisville-will-still-use-race-in-admissions-president-says\/\" target=\"_blank\" rel=\"noopener\">U.
