{"id":139904,"date":"2024-01-04T00:12:33","date_gmt":"2024-01-04T05:12:33","guid":{"rendered":"https:\/\/www.thecollegefix.com\/?p=139904"},"modified":"2024-01-04T13:49:25","modified_gmt":"2024-01-04T18:49:25","slug":"ftc-lawsuit-prompts-gcu-to-accuse-biden-administration-of-extreme-anti-christian-bias","status":"publish","type":"post","link":"https:\/\/www.thecollegefix.com\/ftc-lawsuit-prompts-gcu-to-accuse-biden-administration-of-extreme-anti-christian-bias\/","title":{"rendered":"FTC lawsuit prompts GCU to accuse Biden administration of extreme anti-Christian bias"},"content":{"rendered":"<p><strong>UPDATED<\/strong><\/p>\n<p><strong><em>University leaders: Biden admin \u2018weaponizing\u2019 government against Christians<\/em><\/strong><\/p>\n<p>Grand Canyon University leaders accused the Biden administration of singling out their institution for its Christian beliefs after the federal government filed a second lawsuit against the school in late December.<\/p>\n<p>The Dec. 27 <a href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/GCUComplaintfinalPublicVersion.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> from the Federal Trade Commission alleges the private university in Arizona, its for-profit marketing arm Grand Canyon Education, and University President Brian Mueller engaged in deceptive advertising, \u201cabusive telemarketing practices,\u201d and other violations.<\/p>\n<p>Mueller said in a <a href=\"https:\/\/docs.google.com\/document\/d\/1gNULVgvuIKOJS2Oeclqccdlx2fBR8xyv\/edit?pli=1\">statement<\/a> provided to <em>The College Fix <\/em>that the FTC and, in a separate case, the U.S. Department of Education, have unfairly targeted Grand Canyon University under the Biden administration. He said GCU has a \u201cstellar\u201d reputation, record enrollment numbers, and 15-year tuition freeze.<\/p>\n<p>\u201cRather than applaud those efforts or try to understand why students are choosing GCU in record numbers, these federal government agencies seem more focused on an ideological agenda aimed at stopping a university that has used two cornerstones of American society \u2013 the free market system and a Christian worldview perspective \u2013 to become the largest Christian university in the country,\u201d he said.<\/p>\n<p>But FTC spokesperson Douglas Farrar told <em>The Fix<\/em>\u00a0the lawsuit is based on findings from a \u201cthorough investigation,\u201d not religious discrimination.<\/p>\n<p>\u201cOur lawsuit was filed following a thorough investigation, and our allegations are based on the facts and the law,\u201d Farrar told <em>The Fix<\/em> this week in an email. \u201cTo falsely state that the FTC\u2019s lawsuit is based on religious or political discrimination is a disservice to the students harmed by the alleged deceptive and illegal practices pursued by Grand Canyon University and its president, Brian Mueller.\u201d<\/p>\n<p>In the case, the FTC alleged the university deceptively advertised itself as a nonprofit institution despite operating \u201cfor the profit of GCE and its investors,\u201d which receive 60 percent of the university\u2019s revenue.<\/p>\n<p>The lawsuit cited the Department of Education\u2019s November 2019 refusal to recognize GCU as a nonprofit for the purposes of federal funding.<\/p>\n<p style=\"text-align: center;\"><strong>MORE: <a href=\"https:\/\/www.thecollegefix.com\/biden-administration-targets-largest-christian-university-in-u-s-fines-it-37-7m\/\" target=\"_blank\" rel=\"noopener\">Biden administration fines largest Christian university $37.7M<\/a><\/strong><\/p>\n<p>Mueller disputed these charges in his statement, saying GCU identified itself as a nonprofit for 18 months after receiving approval from the IRS, which was before the DOE\u2019s determination.<\/p>\n<p>Mueller said the FTC\u2019s decision to raise the issue now \u2013 almost five years later \u2013 is the \u201cheight of absurdity.\u201d<\/p>\n<p>GCU also has been lawfully recognized as a nonprofit by the IRS, the state of Arizona, and the Higher Learning Commission, he said.<\/p>\n<p>The FTC complaint also alleged that GCU deceptively marketed its accelerated doctoral programs by telling prospective students it requires 20 classes \u2013 when it actually requires almost all students to take more than that.<\/p>\n<p>But Anthony Rotolo, a 2022 graduate of GCU with a doctorate in philosophy, told <em>The Fix<\/em> that these allegations \u201creally bothered\u201d him because they are not consistent with his experience.<\/p>\n<p>He said the program was affordable and flexible, and GCU made it clear that achieving a doctorate in four years, as he did, was a very accelerated program.<\/p>\n<p>Prior to GCU, Rotolo said he taught digital and social media courses as an assistant professor at Syracuse University in New York, so he knows academia.<\/p>\n<p>He told <em>The Fix<\/em> that he wonders if GCU is being targeted because the university makes it easier for people of all backgrounds to earn a doctorate &#8212; and it&#8217;s disrupting the \u201celitist\u201d higher education system.<\/p>\n<p>\u201cFolks at the education department are the same folks who have emerged from that system,\u201d he said. \u201cI think what GCU is doing is a positive thing for higher education in the U.S. \u2026 Alternatives are good, and disrupting the system is good.\u201d<\/p>\n<p>Other allegations in the FTC complaint alleged the university violated the Telemarketing Sales Rule by calling people who had requested not to be contacted or who were listed on the National Do Not Call Registry.<\/p>\n<p>The FTC is committed \u201cto protect consumers from alleged misrepresentations and illegal conduct related to education,\u201d the federal agency said in a <a href=\"https:\/\/www.ftc.gov\/business-guidance\/blog\/2023\/12\/ftc-complaint-charges-grand-canyon-university-deceptive-advertising-illegal-telemarketing\" target=\"_blank\" rel=\"noopener\">statement<\/a> Dec. 28 about the case.<\/p>\n<p>However, GCU leaders <a href=\"https:\/\/supportgcu.com\/#\/3\/\" target=\"_blank\" rel=\"noopener\">said <\/a>the allegations are \u201cfrivolous,\u201d and the federal government is making a coordinated effort to cause \u201charm\u201d to the largest Christian university in the U.S.<\/p>\n<p>\u201cThe FTC\u2019s allegations related to GCU and GCE are unfortunately yet another example of the Biden Administration weaponizing federal government agencies in a coordinated effort to target institutions to which they are ideologically opposed,\u201d the university said in a Dec. 27 statement.<\/p>\n<p>Currently, the university also is embroiled in a separate legal battle with the Department of Education regarding its nonprofit status. The case is pending in the Ninth Circuit Court of Appeals.<\/p>\n<p>Additionally, in October, the department fined GCU a record $37.7 million for allegedly misstating the cost of its doctoral programs, <em>The Fix<\/em> <a href=\"https:\/\/www.thecollegefix.com\/biden-administration-targets-largest-christian-university-in-u-s-fines-it-37-7m\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> at the time.
